1. Introduction & Acceptance

These Terms of Service (“Terms”) govern your access to and use of our website (the “Site”) and the purchase of products through our online store.

By visiting the Site or placing an order, you agree to be bound by these Terms and the policies referenced herein (including our Privacy Policy, Cookie Policy, Shipping Policy, Refund Policy, and Exchange & Returns Policy).

If you do not agree, do not use the Site.

 

Throughout these Terms, “Company,” “we,” “us,” or “our” refers to Mateo Moretti, and “you” or “customer” refers to any Site visitor, user, or purchaser.

 

We may update these Terms at any time. The current version will be posted on this page with the “Last Updated” date.

Your continued use after changes take effect constitutes acceptance. For material changes, we will provide notice (e.g., site banner or email) at least 14 days before the new Terms take effect.

 

2. Website Use & Account

You must be at least 18 years old (or the age of majority in your jurisdiction) to make a purchase.

You are responsible for safeguarding your account credentials and for all activity under your account.

All information you provide must be accurate and current. You agree to use the Site only for lawful purposes and in compliance with these Terms.

 

We grant you a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes.

All content on the Site (text, images, logos, product designs, etc.) is our intellectual property or that of our licensors and protected by applicable laws.

You may not copy, reproduce, distribute, sell, or exploit Site content without our express written permission. We may suspend or terminate access for violations.

 

3. Product Orders & Payment

Order Process: When you place an order, you make an offer to purchase the selected product(s).

After submission, you will receive an order confirmation email acknowledging receipt (not final acceptance).

We officially accept your order when we charge your payment method and dispatch the product(s).

We may refuse or cancel any order at any time (e.g., suspected fraud, inventory issues, pricing/info errors). If canceled after charge, we will notify you and refund amounts paid.

 

Order Changes/Cancellation: We process orders quickly and cannot guarantee modifications or cancellations after placement.

If the order has shipped or is in fulfillment, it cannot be canceled. You may return eligible items under our Return Policy.

 

Pricing & Availability: Prices are shown in U.S. Dollars (USD) unless stated otherwise, exclusive of applicable taxes.

We strive for accuracy but may correct errors. If a product was listed with an incorrect price or information, we will contact you to confirm the corrected details; you may proceed or cancel for a full refund.

Products are subject to availability. If an item is out of stock/backordered, we will notify you and may offer an alternative or refund.

 

Payment: We accept major credit/debit cards, PayPal, and other methods shown at checkout.

By submitting payment, you represent you are authorized to use that method. Payments are processed by third-party processors; we do not store card numbers.

If payment fails or is later charged back, we may cancel the order or recover the shipment. Prices, promotions, and availability may change without notice.

 

4. Taxes & Duties

U.S. orders may be subject to sales tax calculated at checkout. For shipments outside the U.S., you are the importer of record and responsible for any import duties, VAT/GST, customs fees, and related charges.

These are not included in our product prices or shipping fees. If you refuse to pay and the shipment returns, we may deduct return costs and applicable fees from your refund.

 

5. Shipping & Delivery

We fulfill orders via professional third-party logistics partners.

Processing Time: Typically 1–3 business days (Mon–Fri, excluding holidays) after payment confirmation; may be longer during peak periods.

Methods & Timing: We offer free standard shipping on all orders. Typical U.S. transit: ~5–7 business days. International transit: varies by destination (~7–14 business days on average) and excludes customs delays.

We use reputable carriers (e.g., USPS, UPS, FedEx, DHL). Tracking will be emailed when your order ships. Expedited options (if available) are shown at checkout.

Delivery Estimates: Provided dates are estimates, not guarantees. Delays outside our control (carrier issues, weather, customs, etc.) may occur. We will help communicate with the carrier to resolve issues.

 

Risk of Loss & Title: Title and risk of loss pass to you upon delivery to the shipping address on your order.

If a package is lost or damaged in transit, contact us within 14 days of the carrier’s stated delivery date; we will work with the carrier and, if appropriate, send a replacement or refund.

 

Incorrect/Undeliverable Addresses: Please ensure your address is complete and accurate.

If a package is undeliverable or refused and returned, we may charge reshipping fees or deduct return costs (and any handling fee) from a refund.

6. Returns, Exchanges & Refunds

30-Day Return Window: You may return eligible products within 30 days of delivery for a refund or exchange, provided items are in original, unused condition with all packaging and accessories intact.

How to Return: Contact customer support for authorization and instructions before sending items back; we may provide an RMA or a specific return address.

Who Pays Return Shipping: You pay return shipping, except where we sent a defective or incorrect item—then we provide a prepaid label (where available).

Processing: Refunds to the original payment method are typically processed within 7–10 business days after we receive and inspect your return.

Exclusions: Final-sale items, customized/engraved products, and items that are used or damaged (not due to a verified defect) are ineligible.

Exchanges: Request an exchange during your return authorization.

EU/UK Consumers: You may have a 14-day statutory right to withdraw from distance purchases. If exercised, you must return items within 14 days of notice; we will refund within 14 days of receipt or proof of return, less any permitted deductions for diminished value.

 

7. Product Descriptions, Specs & Warranty

We attempt to describe products accurately; however, colors/finishes may appear differently due to display settings and lighting.

Watches purchased from www.mateomoretti.com are warranted for 12 months from the purchase date against manufacturing defects in materials and workmanship.

Not Covered: Normal wear (straps, coatings, scratches), batteries, accidental damage, misuse, water damage beyond the stated rating, or damage from alteration/unauthorized repair.

Remedy: At our option, we will repair or replace the defective product with the same or comparable model. Proof of purchase may be required.

Shipping for Warranty: For approved claims within the U.S., we cover return shipping back to you; initial shipping may be your responsibility unless prohibited by law.

 

8. User Reviews & Content

By posting a review, photo, or comment, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, and display such content for marketing, support, and Site operation.

You represent you own or control the rights to your content. We may moderate or remove content that is unlawful, deceptive, infringing, or off-topic.

 

9. Intellectual Property

All trademarks, logos, and service marks displayed on the Site are our property or that of third parties. You may not use them without prior written permission.

 

10. Copyright Complaints

11. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase/use of products.

Our total aggregate liability shall not exceed the amount you paid for that product or service.

 

12. Force Majeure

We will not be liable for any failure or delay in performance due to events beyond our control, including natural disasters, fires, epidemics, governmental actions, war, terrorism, supply-chain interruptions, and internet outages.

 

13. Governing Law; Dispute Resolution

These Terms are governed by the laws of the United States and the State of Wyoming.

Agreement to Arbitrate: Except for claims in small-claims court or injunctive relief, disputes will be resolved by binding arbitration under the AAA Consumer Arbitration Rules.

No Class Actions: Disputes are arbitrated only individually. You may opt out within 30 days of first purchase by emailing info@mateomoretti.com.

 

14. Prohibited Uses

You may not misuse the Site, including scraping, reverse-engineering, interfering with security, or placing fraudulent orders.

 

15. Changes to the Site & Services

We may modify, suspend, or discontinue any part of the Site or offerings at any time without liability. For material Terms changes, we will give at least 14 days’ prior notice.

 

16. Miscellaneous

Severability: If any provision is unlawful or unenforceable, the remainder remains in effect.

No Waiver: Failure to enforce a right is not a waiver of it.

Assignment: You may not assign rights/obligations without prior consent. We may assign to an affiliate or in connection with a merger or sale.

Entire Agreement: These Terms and incorporated policies constitute the entire agreement between you and us.
